Introduction
(a) These terms and conditions (Terms) are entered into between HAIRPOPMAN® (we, us, our) and you (being the original recipient of this offer to which these Terms refer).
(b) This offer (defined below in 2(a)) is valid in all our stores in Australia indefinitely and is not applicable in conjunction with other promotional offers, such as discount vouchers or gift cards, unless expressly indicated by us.
(c) You accept these Terms by participating in the offer.
Eligibility Criteria
(a) As part of the offer, you will receive a haircut for $19 (Special Boys Offer) in all our stores in Australia.
(b) You can participate in the Special Boys Offer:
i. if you are a preschool, primary school-aged child or a teenager up to 18 years and 6 months old;
ii. indefinitely.
Offer
(a) The Offer starts from the publication date of these Terms and is only available if you meet the Eligibility Criteria in clause 2.
(b) The Offer applies to our haircut service that includes a consultation, hair wash, haircut, and hot towel treatment (Haircut).
(c) There is no limit to the number of Haircuts and appointments you can book.
(d) The Offer is valid in all our stores in Australia on weekdays only, from Monday to Friday, excluding Saturdays and Sundays.
(e) We reserve the right to extend, withdraw, or amend this Offer (including with respect to the discount on Haircut prices in the Special Boys Offer) at any time at our sole discretion. If this Offer is withdrawn or amended, we will honor the Offer before it was withdrawn or amended, provided that the Eligibility Criteria are met.
Privacy
(a) We collect personal information from you in order to make the Offer available and may, for this purpose, collect, use, and disclose such information to third parties, including but not limited to agents, contractors, service providers, and as required, to regulatory authorities.
(b) Please see our Privacy Policy (available at https://www.hairpopman.com.au/privacy-policy) for more information about how we collect, store, use, and disclose personal information, including details about overseas disclosure, access, correction, how you can make a privacy-related complaint and our complaint-handling process. By providing personal information to us, you agree to the collection, use, storage, and disclosure of that information as described in these Terms and in our Privacy Policy.
General
(a) The Special Boys Offer only applies to our new Pop stores and is not available at our other stores.
(b) The Special Boys Offer is available during our store's
trading hours in the offer period. Please note our store trading hours are subject to the trading hours of the Shopping Centre.
(c) The Special Boys Offer applies to Haircuts only, and does not include additional services (such as Zero Fade, Skin Fade, and Beard Trim) or shaving treatments (including Pop-Relax or Head Shave).
(d) If we become aware, or have reason to suspect, that you have breached these Terms, you may be disqualified from participating in the Special Boys Offer for the offer period.
(e) We accept no liability if you are unable to book an appointment with us during the offer period.
(f) Any decision made by us regarding the Offer is final in all matters.
(g) If you are not satisfied with your Haircut during the offer period, you may notify us using our contact details below or as set out on our website, but we will have sole discretion as to whether we re-supply a Haircut to you.
(h) There are no refunds for any Haircuts provided during the offer period.
(i) To the maximum extent permitted by law, we shall have no liability for any website failure, any malfunction of computers, servers or providers, communications and facilities, any acts or omissions by you and any loss, damage, personal injury or death (whether direct, indirect, special or consequential) caused in any way by participating in this Offer or in connection with the Special Boys Offer, except for any liability caused or contributed to by our negligence.
(j) Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any legislation which cannot lawfully be excluded or limited, including the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) and any other applicable State or Territory legislation.
(k) These Terms and Conditions are governed by the laws of NSW and QLD. Each Party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts operating in NSW and QLD and any courts entitled to hear appeals from these courts.
(l) A reference in these Terms to ‘$’ or ‘dollars’ refers to the currency of Australia from time to time. A reference to time in these Terms is to local time in NSW and QLD.
(m) All taxes (excluding GST) which may be payable as a consequence of participating in the Special Boys Offer are your sole responsibility.
(n) These Terms and Conditions represent the entire agreement between us and you with respect to its subject matter and supersede any prior agreement
, understanding or arrangement between us and you, whether oral or in writing.
(o) Neither party will be liable for any delay or failure to perform their respective obligations under these Terms if such delay or failure is caused or contributed to by a Force Majeure Event (Force Majeure Event). Force Majeure Event means any event or circumstance which is beyond a party’s reasonable control and which could not have been prevented or avoided by that party taking all reasonable steps.
